Delivery, Terms & Conditions Agreement
By signing this e-signature document, customer or agent for customer or company has inspected all products and artificial turf to be of proper length, width and size/weight ordered on Invoice and accepts these products as is on this date and time of e-signature document.
Please note all products are available in what the shopping cart shows. Login to see available widths. Artificial Grass & Landscaping (AGL) can cut rolls to desired length but the width will still remain what is shown on checkout.
All discounted turfs, product specials, custom turfs, and remnant sales are final, “as is” with no returns or exchanges for any reason. A custom cut is any roll we have to cut and those sales are final. If product is discounted from website price it is considered a product special and all sales are final. Cardholder/Customer agrees they cannot file a chargeback or dispute of not described as they have inspected delivery and have been given sample of product.
All deliveries to residences are curbside delivery only. Drivers will not move turf or put any products in backyards. You must move arrange to move all products off of truck.
On full rolls only before installation or cutting, verify products are acceptable. No claims will be accepted or considered after installation or cutting of turf. AGL must be notified of damage and/or incorrect products (shipped only) within 2 days of delivery.
Unopened and uninstalled product (other than custom cut turf) can be returned in its original packaging within 15 days of delivery with the buyer responsible for the return shipping costs and a 25% restocking fee. Buyer must notify AGL by email within 2 days of receipt of product to obtain a Return Authorization. Running line, stocked inventory turf models only. No returns on custom turf orders.
All product specifications are standard and may vary slightly due to manufacturing tolerances and material availability. I.e. tuft gauge, dye lot color, etc.
All pictures of turf products are representative of the look and color of the turf and may not be actual.
AGL may issue a credit or replace any damaged products that falls within the scope of the Artificial Grass & Landscaping standard warranty. Buyer agrees that Artificial Grass & Landscaping’s liability is limited only to the portion of the product that is deemed damaged by Artificial Grass & Landscaping. Due to slight fading a perfect match is not guaranteed.
Claims for product damage due to shipping will be processed with the freight company and will be replaced as quickly as possible pending the shipping companies’ settlement of the claim. Buyer must report shipping damage immediately to AGL and Freight company and buyer must not sign for receipt of the products clean and clear. If products received by the buyer are damaged and the buyer has signed for the product clean and clear, and in good condition no claim can be filed. It is important NOT to sign for damaged product. Damages on packaging material or product backing that do not affect synthetic grass product performance or grass appearance are not acceptable for return. Please make sure to keep or take a photo of the label and bill of lading affixed to the packaging. This label is needed to identify your order and is REQUIRED to resolve any issues regarding your order, and/or to initiate a return or replacement.
In no event shall Artificial Grass & Landscaping be liable, whether in contract or in tort (including negligence) or under any other legal theory (including strict liability), for the loss of goodwill, profits or revenues, personal injury, loss of use or similar economic loss, or for indirect, special, incidental, consequential, punitive or similar damages arising out of or in connection with the use, defect, condition, possession, performance, maintenance, non-delivery or late delivery of the products. In no event shall Artificial Grass & Landscaping’s aggregate liability exceed the sum of the amounts actually paid by Buyer to Artificial Grass & Landscaping. Seller also disclaims any implied warranties in fact or by law or otherwise, including without limitation, any implied conditions or warranties as to merchantability or fitness for a particular purpose.
Any claims by Buyer for defects or nonconformance must be reported to Artificial Grass & Landscaping in writing along with pictures and written explanation within 2 days of the delivery. Buyer agrees to settle any dispute or claims directly with Artificial Grass & Landscaping in strict accordance with the terms and conditions listed above from Artificial Grass & Landscaping Inc.
